Noida Consumer Forum Orders Ajnara India to Refund ₹1.71 Lakh for Delayed Flat Delivery.

The Noida District Consumer Disputes Redressal Commission (DCDRC) has directed Ajnara India Ltd to pay ₹1.71 lakh along with 6% annual interest to a homebuyer for failing to hand over a flat booked in 2018 or refund the booking amount. The commission also awarded ₹4,000 towards litigation expenses and mental agony. The complainant, a Dadri resident, had booked a residential unit in August 2018 by paying an initial amount of ₹11,000, followed by additional payments as demanded by the developer. However, no allotment letter was issued, and the project failed to take off. Despite assurances and an indemnity bond promising a refund, the amount was not returned. Rejecting the developer’s claim that a National Company Law Tribunal order stalled the project, the commission held that the NCLT order applied to a different project. It ruled that the developer’s actions amounted to a clear deficiency in service and ordered payment within 30 days.
