The Kerala High Court has ordered the arrest of the Liberian-flagged vessel 'MV MSC MANASA F'.
Operated by Mediterranean Shipping Company (MSC), in response to a maritime suit filed by cargo owner Saji Surendran. Surendran, proprietor of Mangalath Cashews, claimed a loss of ₹1.54 crore following the sinking of 'MSC ELSA 3' off Kerala’s coast on May 25. He alleged the vessel sank due to technical defects, unseaworthiness, and improper cargo stowage, holding MSC responsible. Arguing that both 'MSC ELSA 3' and 'MSC MANASA F' are managed by MSC and registered under its subsidiaries, Surendran sought the arrest of 'MSC MANASA F' as security for his claim, since MSC holds no assets in India. Justice MA Abdul Hakhim ordered the ship’s arrest at Vizhinjam Port until MSC deposits the amount or provides equivalent security. Although MSC’s counsel offered to furnish security immediately, the court issued a conditional arrest pending confirmation.
