Delhi HC Refuses to Quash Criminal Case Against Supertech Executives

The court says that allegations involving fund utilisation, buyer representations, and alleged conspiracy require an evidence-based examination.

The Delhi High Court has refused to quash criminal proceedings against Supertech chairman and managing director Ram Kishor Arora and other executives in a case linked to the Hill Town residential project in Sohna, Haryana. The executives face allegations of cheating, criminal breach of trust, diversion of funds, non-payment of pre-EMIs, and delays in handing over flats. Justice Madhu Jain upheld the trial court’s 2025 decision to take cognisance of the charges, observing that the allegations went beyond delayed possession. The court noted alleged structuring of transactions, representations made to homebuyers, and the continued collection of funds. The High Court said such allegations cannot be treated as purely civil disputes at this stage. It also observed that criminal conspiracy is generally inferred from conduct and circumstances, as direct evidence of an agreement is rarely available. Whether a meeting of minds existed among the accused will ultimately be determined after evidence is examined during trial.
