Goa Builder Ordered to Pay ₹19.7 Lakh Maintenance Dues.

Unsold units remain the builder’s maintenance responsibility.

The Goa Department of Cooperation has directed Kurtarkar Real Estates to clear nearly ₹19.7 lakh in maintenance dues for 39 unsold units at the Kurtarkar Landmark housing complex in Gogol, Margao. The dues relate to 22 flats and 17 commercial shops retained by the developer in the 207-unit project. Reconciliator Adv Milly Andrade ruled that builders must contribute to maintenance costs for unsold units, regardless of whether they are occupied. The developer’s objections regarding society membership, occupancy-based liability and the limitation period were rejected. The authority ordered payment of ₹19,74,716 in arrears, along with 18% annual interest and applicable late fees from the respective invoice due dates. Kurtarkar Real Estates must also continue paying monthly maintenance charges on the unsold units until they are sold and transferred. The developer was further directed to bear the proceedings’ costs.
