Rajasthan HC Seeks Govt Response on Rent Control Act Provisions.

Tenant Challenges Delays in Rent Disputes, Cites Electricity Disconnection as Essential Amenity Issue. 

The Rajasthan High Court has issued notices to the state government and other respondents on a petition challenging provisions of the Rajasthan Rent Control Act, 2001. The petition, filed by Jaipur shop tenant Vipin Singh, challenges Sections 22-A and 23(3), alleging that the existing mechanism causes excessive delays in resolving landlord-tenant disputes. Singh claimed that his landlord disconnected electricity to his shop in October 2025 without prior notice. He subsequently approached the Rent Authority in Jaipur seeking restoration of the connection, but his application remained pending. The petitioner has also questioned the appointment of Rajasthan Administrative Service officers, not below the rank of Sub-Divisional Officer, as Rent Authorities. He argued that SDOs already have significant administrative responsibilities, which may affect the timely disposal of rent matters. The petition further contends that Section 23 prohibits landlords from withholding essential amenities. Singh argued that electricity is an essential service and its denial affects the fundamental right to life under Article 21 of the Constitution.
