Ghaziabad Consumer Forum Orders Builders to Refund ₹7 Lakh to Homebuyer After 16-Year Delay.
The District Consumer Disputes Redressal Commission in Ghaziabad has ordered two real estate developers to refund ₹7 lakh with interest to a homebuyer after failing to deliver a flat booked in 2008. The order, passed on April 17, also imposed a penalty of ₹10,000 each on Shreya Developwell Private Limited and Sangwan Heights Private Limited, directing them to comply within 30 days. The complainants had initially invested ₹6 lakh in a project by Shreya Developwell, which was never completed. Despite repeated refund assurances, payments were delayed, and the buyers were later persuaded to shift their investment to a new project by Sangwan Heights, paying an additional ₹1 lakh. The commission observed that ₹3 lakh remained with Shreya Developwell and ₹4 lakh with Sangwan Heights. Holding both developers guilty of deficiency in service, the forum directed refunds with interest, noting that the buyers were denied both possession and timely repayment despite repeated promises.
